Terms of Service

These Terms govern your use of firsttakelab.com and First Take Lab (“we”, “us”, or the “service”). By using the service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.

First Take Lab is an independent tool that provides browser access to hosted AI models. Seedance is developed by ByteDance Seed. First Take Lab is not affiliated with, sponsored by, or endorsed by ByteDance.

Eligibility and accounts

You must be legally able to enter into these Terms and old enough to use the service in your jurisdiction. Provide accurate account information, keep access credentials secure, and notify huangxiaofeng775@gmail.com if you believe an account has been compromised. You are responsible for activity performed through your account unless prohibited by law.

The service

The service lets you submit prompts and authorized media to third-party inference providers, monitor a task, and access the returned output. Model availability, queue time, parameters, safety rules, pricing, and output quality can change. An advertised model capability does not guarantee that every prompt will produce a usable result.

Credits, subscriptions, and payments

• Credit charges are shown before a generation request is submitted.
• Starter credits are limited promotional credits, may expire, and are not cash.
• Paid credits, subscription credits, expiration, and plan benefits are described at checkout and on the pricing page.
• Taxes, currency conversion, and payment-provider charges may apply where shown by the checkout provider.
• You authorize the selected payment provider to charge the displayed amount.
• Subscription cancellation stops future renewal but does not retroactively refund already delivered credits or completed service, except where required by law or expressly stated at checkout.

Generation failures and refunds

When a provider submission fails, a queued provider task fails, or a server timeout is settled as failed, the service is designed to return the generation charge once through an idempotent refund path. If a generation completes successfully but you dislike the creative result, the provider inference has still been consumed and the generation charge is not returned.

For payment refunds, duplicate charges, missing purchased credits, or a task that appears incorrectly settled, contact huangxiaofeng775@gmail.com with the account email and transaction or task identifier. Any mandatory consumer refund rights remain unaffected.

Your content and outputs

You retain the rights you already hold in prompts and uploaded material. You grant us and our service providers a limited license to host, transmit, process, and transform that material only as needed to operate, secure, and support the service.

You are responsible for confirming that you have the rights, permissions, and consents needed for any prompt, person, image, audio, video, trademark, or other material you submit. AI outputs may resemble existing material, contain errors, or fail to be unique. We do not guarantee that an output is eligible for copyright, free from third-party claims, accurate, or suitable for a particular use.

Commercial use is permitted only when allowed by your plan, the applicable model/provider terms, and law. You are responsible for the final use and any required disclosures.

Prohibited use

You may not use the service to:

• violate law or another person’s privacy, publicity, intellectual-property, or contractual rights;
• create sexual content involving minors, non-consensual sexual content, or exploitative content;
• create deceptive impersonation, fraud, harassment, threats, or unlawful manipulation;
• submit graphic abuse, instructions for self-harm, malware, credential theft, or attempts to compromise systems;
• animate or represent a real person without the rights and consent required for that use;
• bypass safety checks, credit controls, account limits, IP limits, or provider restrictions;
• probe private networks, use unsafe media URLs, automate abusive traffic, resell accounts, or interfere with the service.

We may reject requests, remove access to content, suspend accounts, preserve necessary evidence, or cooperate with lawful investigations when we reasonably believe these rules have been violated.

Third-party services

The service depends on third parties such as fal.ai, Cloudflare, authentication providers, analytics services, and payment processors. Their own terms and policies can apply to their part of the service. We are not responsible for third-party outages, policy changes, or actions outside our reasonable control.

Availability and changes

We may add, change, limit, pause, or discontinue models, features, prices, credits, or the service. We will not deliberately reduce an already completed credit purchase without a valid operational, legal, fraud, or account reason. Maintenance, provider queues, safety review, and outages can delay or prevent generation.

Disclaimers

To the maximum extent permitted by law, the service and outputs are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

Limitation of liability

To the maximum extent permitted by law, First Take Lab will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of data, or loss arising from third-party services or use of an AI output. Our aggregate liability relating to the service will not exceed the greater of the amount you paid to First Take Lab during the three months before the event giving rise to the claim or USD $100. Limits do not apply where prohibited by law.

Termination

You may stop using the service or request account closure. We may suspend or terminate access for material breach, fraud, abuse, security risk, legal requirement, or prolonged nonpayment. Provisions that by their nature should survive termination—including payment records, rights in content, disclaimers, liability limits, and dispute provisions—will survive.

Governing terms and disputes

Applicable law and courts with lawful jurisdiction govern these Terms, subject to any mandatory consumer protections in your place of residence. Before filing a formal claim, please contact huangxiaofeng775@gmail.com so the issue can be investigated and, where possible, resolved.

Changes and contact

We may update these Terms as the product, providers, or law changes. The updated date above identifies the current version. Continued use after an update means you accept the revised Terms to the extent permitted by law.
